WAIT LIST - Amenity Preview Tours

By Signing up for the waitlist, I along with any of my family members, tenants, guests, and invitees have fully read and agree to the below waiver: GENERAL RELEASE, HOLD HARMLESS & INDEMNIFICATION AGREEMENT

The undersigned being an age equal to or greater than eighteen (18) years (the “Releasor(s)”), desire(s) to enter an active construction site at Telaro, located at 10400 SW Miraflores Blvd., Port St. Lucie, Florida (the “Property”), owned by MATTAMY PALM BEACH LLC, a Delaware limited liability company, having a mailing address located at 2500 Quantum Lakes Dr., Suite 215, Boynton Beach, Florida 33426 (“Mattamy”).

In order to induce Mattamy to permit the Releasor(s) to enter the Property, without which inducement Mattamy would not permit the Releasor(s) to enter the Property, the Releasor(s) has/have agreed to execute and deliver this General Release, Hold Harmless and Indemnification Agreement (this “Agreement”) and to perform the obligations set forth herein.

NOW, THEREFORE, Releasor(s) on behalf of Releasor(s) and the Releasor(s)’s heirs and personal representatives, does/do hereby release, satisfy and forever discharge Mattamy and all of its respective affiliates and subsidiaries and their respective partners, directors, officers, agents, employees, personal representatives, successors, and assigns (collectively, the “Releasees”), from any damage to the Releasor(s)’s personal property or injury to, including, but not limited to the death of, the Releasor(s), while the Releasor(s) is/are within, upon or around the Property. Further, the Releasor(s), on behalf of the Releasor(s) and the Releasor(s)’s heirs and personal representatives, hereby agrees to fully protect, indemnify, defend, save and hold the Releasees harmless of and from any and all claims, actions, causes of action, suits, demands, personal injuries, in law or in equity, which the Releasor(s) or the Releasor(s)’s personal representatives or heirs hereafter may or shall have against any of the Releasees for any matter whatsoever which may be incurred while in, on or around the Property.

The Releasor(s) expressly acknowledge(s), confirm(s) and agree(s) that (i) the Property is currently under construction, (ii) entry into the Property may be dangerous and hazardous due to such construction and (iii) that entry into and onto the Property is at the Releasor(s)’s sole risk. The Releasor(s) hereby expressly assumes all risk of loss, damage, injury and/or death, which may occur for any reason while the Releasor(s) is/are within, upon or around the Property.

While at the Property, the Releasor(s) expressly agrees (a) to observe all requirements for clothing (i.e., long pants, no loose garments), shoes (i.e., hard sole only, no bare feet, sandals or open-toed shoes) and protective headgear (i.e., hard hat), (b) observe all safety requirements expressed to the Releasor(s) by any representative of Mattamy and (c) remain within only those areas of the Property designated by a representative of Mattamy.
